Terms & Conditions

Welcome to Vizzuals. These Terms & Conditions (“Terms”) govern your use of Vizzuals.com, your Vizzuals membership, and the services, tools, information, benefits, and communications provided by Vizzuals.

By creating an account, purchasing a membership, or using Vizzuals.com, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use Vizzuals.

If you are under the age of legal majority in your state, province, or jurisdiction, you must have the permission and supervision of a parent or legal guardian to create or use an account or purchase a membership.

A parent or legal guardian who permits a minor to use Vizzuals accepts responsibility for that minor's use of the website and services.

Use of Vizzuals is subject to all applicable state, federal, and local laws. If the laws where you live require a higher minimum age or impose additional restrictions, those laws apply.

2. Memberships

Vizzuals may offer Monthly, Yearly, and Lifetime membership options.

The benefits, features, tools, services, and pricing associated with each membership may be displayed on Vizzuals.com at the time of enrollment.

Membership provides access only to the services and benefits currently made available by Vizzuals. Specific features, tools, benefits, training, support services, or other membership offerings may be added, changed, replaced, limited, or discontinued at any time.

3. Automatic Renewal

Monthly and Yearly memberships automatically renew unless canceled before the next scheduled renewal date.

Your applicable renewal date is displayed in the Subscriptions section of your Vizzuals profile.

By purchasing a recurring membership, you authorize the applicable payment method to be charged automatically on the renewal date at the price applicable to your membership at that time, unless you cancel before renewal.

Members are responsible for reviewing their subscription information and renewal date.

4. Cancellation

Members may cancel a recurring membership at any time by accessing the Subscriptions section of their Vizzuals profile and following the cancellation instructions.

Cancellation stops future automatic renewals.

After cancellation, the member will normally continue to have access to the applicable membership until the end of the billing period that has already been paid.

No prorated refund or credit is provided for unused time.

5. No Refund Policy

All Vizzuals membership purchases are final and nonrefundable.

This policy applies to:

  • Monthly Memberships

  • Yearly Memberships

  • Lifetime Memberships

Once a membership payment has been completed, no refund, partial refund, prorated refund, or credit will be issued except where otherwise required by applicable law.

Members are responsible for canceling recurring memberships before their next scheduled renewal if they do not wish to be charged again.

6. Coupons, Promotional Codes, and Gift Cards

Vizzuals may occasionally offer coupon codes, promotional offers, or gift cards that reduce or cover the initial cost of joining.

Unless specifically stated otherwise at the time of the offer, use of a coupon, promotional code, or gift card does not prevent future automatic renewal.

When a promotional or discounted membership period ends, the membership may automatically renew at the then-current full Monthly Membership price.

The applicable renewal information will be presented as part of the membership or subscription information.

Members may cancel before the applicable renewal date to prevent the next charge.

7. Lifetime Memberships

A Vizzuals Lifetime Membership does not represent a guaranteed number of years.

For purposes of these Terms, a Lifetime Membership remains valid for the lifetime of:

  • The individual member;

  • The Vizzuals website or membership service; or

  • The owner/operator of Vizzuals,

whichever ends first.

Lifetime Memberships are nontransferable and may not be sold, assigned, inherited, gifted, transferred to another person, transferred to another household, or transferred to another business, company, organization, or entity.

A Lifetime Membership does not guarantee that every feature, service, tool, benefit, perk, or program available at the time of purchase will continue unchanged for the duration of the membership.

Vizzuals may modify, replace, add, limit, or discontinue individual membership benefits as the website and services evolve.

8. Household Use and Multiple Whatnot Accounts

A Vizzuals membership may be used for multiple Whatnot usernames belonging to the same individual.

One membership may also be shared by immediate family members who permanently reside in the same household.

For example, spouses living together may use one Vizzuals membership for their respective Whatnot accounts.

A membership may not be shared with friends, business associates, customers, clients, extended family members living outside the household, or other individuals who are not eligible under this Household Use provision.

Vizzuals reserves the right to request reasonable verification when account-sharing activity appears inconsistent with these Terms.

9. Lifetime Member Graphics Benefit

Certain Lifetime Memberships may include access to graphics created by Vizzuals.

Graphics provided through this membership benefit are created solely for use by the member or eligible household members on their own Whatnot account or accounts.

Graphics obtained through a Vizzuals membership:

  • May be used on the member's own eligible Whatnot accounts;

  • May not be resold;

  • May not be given away;

  • May not be redistributed;

  • May not be created or requested on behalf of another seller who is not covered by the membership;

  • May not be used to operate a graphic-design or resale service; and

  • May not be commercially transferred to another person or business.

A member may continue using graphics previously created for that member after the membership ends, provided the graphics continue to be used only for the authorized member's own eligible accounts.

Ending a membership does not give the member the right to request additional graphics.

Abuse of the graphics benefit—including requesting graphics for other sellers, giving graphics to others, or selling graphics obtained through the membership—may result in immediate suspension or permanent termination of membership without refund.

10. Vizzuals Content and Intellectual Property

Unless otherwise stated, the content available through Vizzuals is owned by or licensed to Vizzuals.

This may include, but is not limited to:

  • Website content

  • Written materials

  • Training materials

  • Graphics

  • Videos

  • Calculators

  • Analytics tools

  • Reports

  • Worksheets

  • Guides

  • Educational materials

  • Databases

  • Software and website tools

  • Member-only information

  • Original methods, layouts, designs, and resources

Membership gives you permission to use these materials for your own authorized personal or business use.

It does not transfer ownership of Vizzuals intellectual property to you.

You may not reproduce, republish, distribute, sell, resell, license, copy, scrape, commercially exploit, give away, or make Vizzuals member-only materials available to unauthorized individuals without prior written permission from Vizzuals.

11. Member Conduct

Members are expected to interact with Vizzuals, its owner, representatives, and other members appropriately.

Vizzuals may take action against accounts involving conduct including, but not limited to:

  • Harassment;

  • Threats;

  • Abusive or excessively disruptive behavior;

  • Fraud or attempted fraud;

  • Misuse of Vizzuals services;

  • Unauthorized account sharing;

  • Unauthorized reproduction or distribution of Vizzuals materials;

  • Abuse of membership benefits;

  • Abuse of the graphics benefit;

  • Attempts to circumvent membership restrictions;

  • Providing false information to obtain benefits; or

  • Other serious violations of these Terms.

12. Suspension and Termination

Vizzuals reserves the right to suspend, restrict, or terminate a membership when Vizzuals reasonably determines that a member has violated these Terms, abused a membership benefit, engaged in harassment or abusive conduct, committed or attempted fraud, or otherwise seriously misused Vizzuals services.

Termination for violation of these Terms may take effect immediately.

A member whose account is terminated may request that Vizzuals review or reconsider the decision.

Vizzuals will determine whether an appeal will be granted based on the circumstances presented.

The final determination made by Vizzuals following an appeal is final.

If a Monthly, Yearly, or Lifetime Membership is terminated because of a violation of these Terms, the member forfeits remaining membership access and will not receive a refund, partial refund, prorated refund, credit, or compensation for unused membership time, except where otherwise required by law.

13. Independent Relationship With Whatnot

Vizzuals is an independent business.

Vizzuals is not owned, operated, sponsored, endorsed, authorized, or affiliated with Whatnot.

References to Whatnot on Vizzuals.com are made because Vizzuals provides independent education, information, resources, and support that may be useful to Whatnot buyers and sellers.

Whatnot is responsible for its own platform, policies, services, decisions, and operations.

14. Educational Information and No Guarantee of Results

Vizzuals provides educational information, seller support, training, tools, calculators, analytics, opinions, recommendations, and other resources.

These resources are intended to assist members but do not guarantee any particular result.

Vizzuals does not guarantee sales, revenue, income, profits, followers, viewers, customers, business growth, platform success, or any other particular outcome.

Results can vary significantly based on factors outside the control of Vizzuals.

Each member remains responsible for making their own business decisions.

15. Your Responsibility as a Seller

Members are solely responsible for their own:

  • Listings;

  • Products;

  • Pricing;

  • Auctions;

  • Sales practices;

  • Shipping practices;

  • Shipping profiles;

  • Packaging;

  • Taxes;

  • Business records;

  • Customer interactions;

  • Giveaways;

  • Promotions;

  • Advertising;

  • Platform activity; and

  • Compliance with applicable rules, policies, and laws.

Information provided by Vizzuals does not replace the member's responsibility to review current Whatnot policies, carrier requirements, tax obligations, laws, regulations, or other rules that may apply to their business.

Vizzuals is not responsible for business losses or other consequences resulting from decisions a member makes based on information, recommendations, calculators, analytics, training, or other materials provided through Vizzuals.

16. Information May Change

Whatnot policies, shipping rules, carrier requirements, fees, platform features, laws, and other third-party information may change.

Vizzuals attempts to provide useful and accurate information, but Vizzuals cannot guarantee that every third-party rule, policy, price, calculation, or requirement will remain unchanged or error-free.

Members should verify information that is important to their individual business circumstances.

17. Text Messaging Terms

Vizzuals offers an optional text messaging program.

By voluntarily providing your mobile telephone number and affirmatively opting in to receive text messages from Vizzuals, you consent to receive SMS or similar text communications from Vizzuals.

Vizzuals text messages may include, but are not limited to:

  • Vizzuals announcements;

  • Upcoming live-show announcements and reminders;

  • Important Whatnot-related news and updates;

  • Training information;

  • Policy-related updates;

  • Membership and service announcements;

  • Customer-service and support responses;

  • Responses to questions submitted by members;

  • Promotional announcements; and

  • Other Vizzuals-related communications.

Vizzuals does not intend to send private or sensitive membership account information through SMS.

Message Frequency

Message frequency varies.

General announcements may typically be sent approximately five times per week. However, the actual number of messages a person receives may be higher or lower depending on Vizzuals activity and the individual's interaction with Vizzuals, including customer-service questions and ongoing text conversations.

Message and Data Rates

Message and data rates may apply.

Your wireless carrier's normal messaging and data charges may apply to messages sent or received through the Vizzuals text messaging program.

Optional Consent

Consent to receive text messages is voluntary.

Consent to receive SMS messages is not a condition of purchasing or maintaining a Vizzuals membership.

You may purchase or use a Vizzuals membership without agreeing to receive promotional or informational text messages.

Opting Out

You may stop receiving Vizzuals text messages at any time by replying:

STOP

After an opt-out request is processed, you will no longer receive messages covered by that SMS consent unless you later opt in again.

Carrier Disclaimer

Carriers are not liable for delayed or undelivered messages.

Wireless carriers and mobile network providers are not responsible for the content of Vizzuals messages.

SMS Privacy

Mobile telephone numbers and SMS consent information are handled in accordance with the Vizzuals Privacy Policy.

Vizzuals does not sell, rent, share, or disclose mobile telephone numbers or SMS opt-in consent to third parties or affiliates for their own marketing or promotional purposes.

18. Third-Party Services and Links

Vizzuals may reference or provide links to third-party websites, platforms, services, or resources.

Vizzuals does not control those third parties and is not responsible for their availability, content, policies, security, accuracy, or operation.

Use of third-party services is subject to the terms and policies established by those third parties.

19. Availability of the Website and Services

Vizzuals does not guarantee uninterrupted or error-free access to the website or any particular feature.

Services may occasionally be unavailable because of maintenance, technical issues, third-party outages, updates, security concerns, circumstances outside the control of Vizzuals, or discontinuation of a feature or service.

20. Limitation of Liability

To the fullest extent permitted by applicable law, Vizzuals and its owner shall not be liable for indirect, incidental, special, consequential, or business-related losses arising from the use of or inability to use Vizzuals services, information, membership benefits, tools, calculators, graphics, training, or recommendations.

Nothing in these Terms limits rights that cannot legally be limited or waived under applicable consumer-protection law.

21. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Before beginning formal legal proceedings, the parties are encouraged to make a reasonable good-faith effort to resolve the dispute directly.

If a dispute cannot be resolved informally, it may be brought before a court with proper jurisdiction in the Commonwealth of Massachusetts, subject to any rights or venue requirements provided by applicable law.

22. Severability

If any portion of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

23. No Waiver

If Vizzuals does not immediately enforce a provision of these Terms, that does not mean Vizzuals has waived the right to enforce that provision later.

24. Changes to These Terms

Vizzuals may update these Terms periodically to reflect changes to the website, membership program, services, policies, legal requirements, or business practices.

Updated Terms will be posted on Vizzuals.com with a revised effective date.

Continued use of Vizzuals after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.

Service providers that assist us in delivering text messages may process mobile information solely for the purpose of providing those communication services and may not use that information for their own marketing or promotional purposes.
